A Temporary Restraining Order (TRO) was issued on December 31 preventing the U.S. Department of Labor rule on “companionship services.” The rule aims to exempt “companionship services” from overtime compensation under the Fair Labor Standards Act, which was due to be in effect as of January 1, 2015. The hearing is set for January 9. Should the rule eventually pass, it would significantly change a longstanding, 40 year-old federal overtime compensation exemption known as the “companionship services” exemption under the Fair Labor Standards Act.
